PLEASE READ THESE TERMS CAREFULLY. THEY AFFECT YOUR LEGAL RIGHTS. IF YOU DO NOT UNDERSTAND ANY PART OF THIS AGREEMENT, PLEASE ASK QUESTIONS OR SEEK LEGAL ADVICE BEFORE ACCEPTING.


DEFINITIONS.
“Artbliss Hotel,” “we,” “us,” or “our” means the property manager. “Guest,” “you,” or “your” means the person who books the reservation and accepts this Agreement, and is responsible for all occupants and invitees. “Property” means the vacation rental you reserved. “Agreement” means these Terms of Service/terms and conditions, together with the reservation confirmation and any house rules or listing-specific terms provided to you.


CHECK-IN/OUT.
Check-in time is 4:00 PM. During peak times, please plan to arrive no earlier than 4:00 PM. If the Property is available and ready earlier, we may allow an early check-in, but we cannot guarantee it. Artbliss Hotel will provide keys/access codes only to the primary guest on the reservation (unless we approve other arrangements in writing).


Check-out time is 10 AM. A late check-out may be allowed, depending on availability. Late check-outs might not be possible during peak times.


Check-in is completed remotely (not in person at our office). We will provide check-in instructions and access details on or before your arrival date, once identity and age verification (if required) are completed.


You may be required to electronically provide a copy of a state-issued driver’s license or other acceptable government ID so we can verify identity and age before we provide access codes. Do not attempt to check in if the primary renter is not at least 25 years old; if age/identity cannot be verified, check-in may be denied.


LATE ARRIVALS.


Our office hours are generally 9:00 AM to 5:00 PM (and until 6:00 PM during the summer season). We will provide access codes before the end of business hours on your arrival day once verification steps are complete. If applicable, keys must be returned to the same lockbox used at check-in.


CANCELLATION POLICY. 


TRAVEL INSURANCE.
We strongly recommend that you purchase travel insurance to cover unexpected events, including illness, weather disruptions, or travel delays. Except where required by law, we do not provide refunds outside the Cancellation Policy.


A deposit equal to 50% of the total reservation amount (including rent, fees, and taxes) is due at booking, and a valid credit card must be kept on file. The remaining balance is due 30 days before arrival (or in full at booking for reservations made within 7 days of arrival). Cancellation requests must be made in writing (email is acceptable) and are effective when received by Artbliss Hotel. If you cancel 30 or more days before arrival, we will refund payments received minus a $25 cancellation fee. If you cancel less than 30 days but more than 7 days before arrival, you will forfeit 25% of the total stay amount. If you cancel 7 days or less before arrival, or do not arrive, you will forfeit 100% of the total stay amount.


THIRD-PARTY WEBSITES.
  Many guests book their stay through third-party websites (for example, VRBO or Airbnb). If you book through a third-party site, your payment and cancellation terms may be set by that site and may differ from the terms stated here. Where there is a conflict, the third-party site’s posted payment/cancellation terms will control for that reservation, and the other terms in this Agreement will continue to apply to the extent they do not conflict.


NO REFUNDS FOR EARLY CHECK-OUTS OR NO SHOWS
. No refunds are provided for early check-out. If you do not cancel in accordance with the Cancellation Policy and you do not arrive (a “no-show”), you will forfeit 100% of the total stay amount.


RESERVATION CHANGES.
  Reservation changes (such as different dates or a different property) may be requested 30 or more days before arrival. If approved, we may allow one change as a courtesy. Additional changes, and changes within 30 days of arrival, are not allowed unless we agree in writing in our sole discretion.


THE PROPERTY. 


WHAT IS PROVIDED.  Kitchens are well equipped with basic cooking needs (dishes, silverware, pots, pans, coffee maker, microwave, and large appliances). Note that food products are not provided for safety reasons. All properties include one set of sheets for each bed. Bath towels are provided based on the property’s maximum occupancy. We do not provide beach towels. A start-up supply of toilet paper (2 rolls per bathroom), 1 roll of paper towels, 2 kitchen trash bags, 1 kitchen sponge, bar hand soap for each sink, dishwasher tablets (if the property has a dishwasher) and 1 bottle of dish soap will be provided. After that, the guest is responsible for any additional needs.


SUGGESTED ITEMS TO BRING.
Beach towels, extra paper goods (toilet paper, facial tissue, and paper towels), extra pillows if you wish to sleep with more than one, coffee and coffee filters, spices/seasoning, bathing soap and shampoo, extra dish soap, extra trash bags, suntan lotion/sunblock and beach gear.


PAYMENT.


AUTHORIZATION TO CHARGE PAYMENT METHOD.
You authorize Artbliss Hotel to charge your payment method on file for amounts due under this Agreement, including rent, taxes, fees, approved add-ons, and charges for damage, missing items, rule violations, or excessive cleaning, to the extent permitted by law. We may place a pre-authorization/hold to verify your payment method.


We accept major credit cards. Quoted rates generally do not include applicable taxes (currently 13% lodging tax), the admin/damage fee, cleaning fees, and pet fees (if applicable). We may correct pricing or availability errors caused by human or system error; if we cannot honor a reservation due to such an error, we will notify you and provide a refund of amounts paid for that reservation.


NON-REFUNDABLE DAMAGE FEE.
  We charge a non-refundable administrative or damage fee with each reservation in lieu of a security deposit (the amount varies by property). This fee covers certain minor, accidental damage up to $500 per stay, provided the damage is promptly reported to us and no later than check-out. Damage above $500, unreported damage, missing or stolen items, and damage caused intentionally, by negligence, or by violation of this Agreement may be charged to the credit card on file. This fee does not cover excess cleaning, smoking-related charges, or pet cleanup fees.


HOME TEAM’S AVAILABILITY/EMERGENCIES.


Artbliss Hotel is available 24 hours a day, with our answering service available outside of normal business hours. Please call us at (361) 749-4255. Note that we are available after hours for urgent matters or emergencies only. Please leave a message and we will promptly return your call if it is an emergency. Emergencies include situations such as a guest being locked out, property leaks, or threats to people or property.  Messages with routine questions and non-emergency issues, such as issues with WIFI service, will be returned when we open in the morning.


AGE REQUIREMENTS.


We rent only to responsible parties who are at least 25 years old. The responsible party must check in and must stay at the property for the full reservation. Keys/access codes will be provided only to the responsible party. Government-issued ID is required at check-in and must match the name on the reservation. We reserve the right to refuse service or deny check-in if these requirements are not met.


Not knowing our age requirements is not a basis for a refund outside the Cancellation Policy.
If the responsible party is under 25 or is not present at check-in, check-in will be denied and the reservation will be subject to the Cancellation Policy, which may result in forfeiture of amounts paid.


PARKING.


Use only the parking spaces assigned to the Property and do not exceed the maximum number of vehicles allowed. Do not park on empty lots or in neighboring spaces. Street parking is not allowed unless the property description specifically states otherwise. No RVs or campers are permitted. Boat trailers are not allowed unless specifically stated in the property description. Violations may result in towing at your expense and/or termination of your stay without a refund.


STRICT OCCUPANCY LIMITS


Maximum occupancy is provided in the listing and confirmed at booking. Exceeding the occupancy limit is a material breach of this Agreement and may result in removal from the Property without a refund for unused nights and/or additional charges (including any fines assessed to us by an HOA, owner, or local authority).


NEIGHBOR POLICIES
.


Observe all no-trespassing signs for adjacent properties. No loud music and no outdoor parties after 10:00 p.m. Please be respectful of neighbors. Violations may result in removal from the Property without a refund. Any non-residential use (including events, parties, bachelor/bachelorette gatherings, or weddings) must be approved in writing by Artbliss Hotel.


PETS.


Pets are allowed only in properties specifically listed as pet-friendly and only with our prior approval. Unauthorized pets are a material breach and may result in removal without a refund of unused nights and a $500 cleaning fee. Unless otherwise stated in the listing, a maximum of two pets is permitted and each pet must weigh 50 pounds or less. A one-time per-stay pet fee applies for approved pets. Pets must be crated if left alone. You must pick up pet waste (a $50 fee applies if you do not). Pets are not allowed in pool areas and must be always leashed outdoors.


SMOKING.


Smoking and vaping are not allowed inside any of our properties. If the listing states that the Property is non-smoking anywhere on-site, smoking and vaping are also prohibited on patios, balconies, and outdoor areas. If there is evidence of smoking/vaping in a non-smoking area, you are responsible for all related cleaning and damage, and we may charge a $500 fee to the credit card on file. If cigarette debris is left outside the Property, an additional $100 grounds-cleaning fee may apply.


PRIVATELY OWNED PROPERTIES.


The guest acknowledges that each property is individually owned and furnished by the owner. No additional furnishings or equipment will be provided.


Some garages, closets, or cabinets may be locked for owner use and are off-limits. Do not enter or attempt to access locked areas; you may be charged for any resulting damage and may be removed for violating this Agreement.


We will make reasonable efforts to address issues such as air conditioning or major appliance failures, but we cannot guarantee repair timing, especially during peak seasons, severe weather, or when parts/service are unavailable.


Every property has cable or satellite TV, and most have internet service. This service is provided by the owners through a 3rd party provider. We cannot make any guarantees as to the speed or reliability of the internet connection or television signal. If there is a problem, please report it to us and we will make every effort to troubleshoot it with the service provider.


ACCOMMODATION SUBSTITUTIONS.


If the Property becomes unavailable due to sale, damage, double booking, required repairs, natural disasters, or other circumstances beyond our reasonable control, we will use reasonable efforts to offer a comparable substitute property (if available) or allow you to cancel. If no comparable substitute is available or you do not accept a substitute, we will refund amounts paid for the unused portion of your stay, and that refund will be your exclusive remedy for the unavailability of the Property (to the extent permitted by law).


SELF-CATERING.


All of our properties are self-catering. No maid or towel service is provided during your stay.


REPAIRS/CONSTRUCTION.


FORCE MAJEURE.
We are not responsible for delays, interruptions, or inability to perform due to events beyond our reasonable control (including severe weather, hurricanes, government actions, utility outages, pandemics, labor shortages, or acts of God). Where performance is materially affected, we will work with you in good faith on reasonable alternatives consistent with the Accommodation Substitutions section and applicable law.


Equipment and services can occasionally malfunction. We will use reasonable efforts to resolve reported issues as quickly as practicable. Except where required by law, no refunds will be issued solely due to temporary interruptions or malfunctioning equipment.


We, the owner, and our vendors may enter the Property as reasonably necessary for repair, maintenance, inspections, safety, or emergencies. We will make reasonable efforts to provide notice in advance when practicable, but no notice may be possible in an emergency.


Do not turn away scheduled service providers (such as landscaping, pest control, or pool maintenance). If you prevent access without our prior approval, we may charge a $100 service-call fee.


All of our properties receive monthly pest control services. With our humid tropical climate, it is still possible to see the occasional bug despite our best efforts.


AMENITIES


Some properties have special amenities (for example, roof decks, hot tubs, spas, and swimming pools). Unless otherwise posted, you may use these amenities during your stay. You understand there are inherent risks associated with these amenities and agree to use them safely and supervise children at all times. You are responsible for damage caused by your misuse, negligence, or violation of posted rules.


We do not control or maintain community pools or other common areas. If there is an issue, report it promptly and we will contact the community/HOA manager when applicable. Except where required by law, we do not provide refunds for closures or non-functioning community amenities outside our control.


Promptly report maintenance problems to Artbliss Hotel by phone during office hours or after hours by email at hello@artblisshotel.com. Except where required by law, no refund or rate adjustment will be made for unforeseen or temporary interruptions of utilities or services (including electricity, water, pool equipment, air conditioning, telephone, TV, cable, internet) or appliances.


PERSONAL PROPERTY/VALUABLES


Lock doors when you leave and do not leave valuables unattended. To the extent permitted by law, Artbliss Hotel and the property owner are not responsible for loss, theft, or damage to personal property. Please check drawers and closets before departure. If you leave an item behind, we may attempt to locate it and mail it back for a $25 handling fee plus postage. Items left behind may be treated as abandoned if not claimed within a reasonable period.


HOLDOVERS


Do not remain in the Property after the approved check-out time without our prior written consent. Unauthorized holdover can disrupt the next guest, create relocation costs, and interfere with cleaning and maintenance. If you hold over, you are responsible for resulting costs (including additional rent, cleaning, and relocation costs, as applicable), and we may take steps permitted by law to regain possession. This Agreement does not create a landlord-tenant relationship.


GUEST RESPONSIBILITIES


The guest who signs this Agreement is responsible for all payments, fees, and obligations under this Agreement, including the conduct of all occupants and invitees. BBQ grills must be left reasonably clean; a $35 fee may be charged for charcoal/food removal or grate cleaning. A $25 fee may be charged for excessive trash (trash that does not fit in provided receptacles and must be hauled away). Where properties have individual trash toters, follow posted trash days and placement instructions; a $75 fee may be charged for toters not placed correctly.


OTHER FEES


A $50 charge may apply for lockouts, extra keys, or non-returned keys. Smoking charges are described in the Smoking section. Each property is inspected before arrival and after checkout. If a property is left excessively dirty, an additional cleaning fee of $30 per hour may be charged. Missing items may be charged at the actual replacement cost. Late check-out fees vary based on the property and the length of the delay.


PENALTY FOR VIOLATION OF THIS AGREEMENT.


If you or your invitees violate this Agreement, we may terminate your stay and require you to leave the Property. Upon notice of termination, you and all occupants must vacate immediately. To the extent permitted by law, you will not be entitled to a refund for unused nights.


NO ORAL MODIFICATIONS.


This Agreement may not be modified, amended, or terminated orally. No modification, amendment, or termination, or any waiver of any of the provisions of this Agreement, shall be binding unless same is in writing and signed by the person against whom such modification, amendment, or waiver is sought to be enforced.


SEVERABILITY


If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.


ENTIRE AGREEMENT; ORDER OF PRECEDENCE. 


This Agreement, together with the reservation confirmation, listing details, and any written house rules provided to you, is the entire agreement regarding your stay. If you booked through a third-party platform, that platform’s terms that specifically govern payment and cancellation will control in the event of a conflict; otherwise, these Terms apply.


NOT A LEASE
.  This is a vacation rental agreement for a temporary vacation stay at a managed vacation rental property. THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY. By agreeing to the Terms & Conditions, you stipulate and agree that you have not and will not receive a real property interest in or rights to the vacation rental property.


NO ASSIGNMENT.
Guest may not assign any part of this Agreement. Any attempted assignment, sublease, or grant without the written consent of Artbliss Hotel will be void.


LIABILITY


LIMITATION OF LIABILITY.
To the extent permitted by law, Artbliss Hotel will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your stay or this Agreement. To the extent permitted by law, Artbliss Hotel’ total liability for any claim will not exceed the amounts you paid to Artbliss Hotel for the reservation giving rise to the claim.


To the extent permitted by law, you agree to indemnify and hold harmless Artbliss Hotel, its affiliates, and the property owner from claims, damages, losses, and reasonable attorneys’ fees arising out of your (or your occupants’ or invitees’) acts or omissions, including property damage, personal injury, or violation of this Agreement. This indemnity does not apply to the extent a claim is caused by Artbliss Hotel’ gross negligence or willful misconduct. We, the owner, and our vendors may enter the Property as reasonably necessary for repairs, maintenance, inspections, safety, or emergencies, and we will make reasonable efforts to provide notice when practicable.


GOVERNING LAW; VENUE


This Agreement is governed by Florida law, without regard to conflict-of-law rules. Unless prohibited by applicable law, any lawsuit arising out of or relating to this Agreement must be brought in the state courts located in Pinellas County, Florida, and each party consents to personal jurisdiction there.


ELECTRONIC SIGNATURE AGREEMENT


Both parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability and admissibility. By selecting the “I Accept” button on Artbliss Hotel company website or a 3rd party website that Artbliss Hotel has utilized to advertise the property, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting “I Accept” you consent to be legally bound by this Agreement’s terms and conditions.


CONSENT TO RECEIVE PROMOTIONAL AND MARKETING COMMUNICATIONS


By submitting your contact information and affirmatively opting in (for example, by checking a box or otherwise authorizing marketing contact), you expressly consent to receive recurring marketing communications from Artbliss Hotel and its affiliated entities via email and text message (SMS/MMS) at the email address and/or mobile number you provide, including messages sent using automated technology (including an auto dialer) and prerecorded/artificial voice (where applicable).

Consent is not a condition of purchase or booking. Message frequency varies. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.


We may share your information with service providers in accordance with our Privacy Policy.
